Terms of Service
1. Acceptance of Terms
By accessing or using PayMyGST ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and PayMyGST.
2. Description of Service
PayMyGST is a GST compliance assistance platform that enables Chartered Accountants (CAs) to capture GST portal OTPs from their clients' Gmail accounts in a secure, read-only manner, facilitating timely GST return filing for MSMEs and SMBs across India.
3. Eligibility
- You must be at least 18 years of age to use this Service
- CA accounts must be operated by registered Chartered Accountants or authorised members of a CA firm
- Client accounts must be operated by the business owner or an authorised representative
- You must provide accurate and complete information during registration
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at karthik@vectra-pay.com if you suspect any unauthorised use of your account. PayMyGST will not be liable for any losses resulting from unauthorised access due to your failure to secure your credentials.
5. Gmail Integration and Permitted Use
By connecting your Gmail account to PayMyGST, you grant us read-only access strictly limited to identifying GST portal OTP emails. You acknowledge and agree that:
- This access is entirely voluntary and can be revoked at any time via your Google Account settings
- We will access only emails from the GST portal (gstin.gov.in) that contain OTP codes
- We will not access, read, store, or process any non-GST emails
- We will not send emails or perform any write or delete operations on your behalf
- OTP values are shared only with your authorised CA for the purpose of GST return filing
- We will not use Gmail data for advertising, profiling, or any purpose unrelated to GST filing
- We will not sell, transfer, or share Gmail data with any third parties other than your authorised CA
- We will not use Gmail data to train AI or machine learning models
- Our use of Gmail data complies with the Google API Services User Data Policy, including the Limited Use requirements
Google API Limited Use Compliance:
The use of information received from Gmail APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Gmail data is used solely to extract GST portal OTP codes for the purpose of facilitating GST return filing on behalf of the user's authorised Chartered Accountant.
6. Prohibited Use of Google User Data
You agree that PayMyGST will not, and you will not request or encourage PayMyGST to:
- Use Gmail data for targeted advertising or any commercial profiling purpose
- Transfer or sell Gmail data to data brokers, advertisers, or any third party for commercial purposes
- Use Gmail data to develop, improve, or train AI or machine learning models
- Transfer Gmail data to any third-party AI or ML services
- Use Gmail data for any purpose beyond extracting GST portal OTP codes for filing purposes
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorised access to any part of the Service or other users' accounts
- Misrepresent your identity or your relationship with any person or entity
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to file false or fraudulent GST returns
- Attempt to reverse engineer, decompile, or extract source code from the Service
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. PayMyGST makes no warranties, express or implied, regarding the Service, including but not limited to availability, accuracy, or fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by applicable law, PayMyGST shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, GST penalties, or data loss, arising from your use of or inability to use the Service.
11. Indemnification
You agree to indemnify and hold PayMyGST harmless from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or engage in conduct that we deem harmful to other users or the Service. You may terminate your account at any time by contacting karthik@vectra-pay.com. Upon termination, your Gmail OAuth access will be revoked and your data will be deleted within 30 days.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
